THESE CONDITIONS WILL AFFECT YOUR LEGAL RIGHTS INCLUDING THE RIGHT TO SUE THE OPERATOR FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF THE OCCUPIERS’ LIABILITY ACT OR TO CLAIM COMPENSATION FOLLOWING AN ACCIDENT

Your use of these premises and facilities and participation in activities on the premises involve various risks, dangers and hazards. Please visit the Safety & Risk Awareness website at: www.skisafety.ca for a description of these risks, dangers and hazards. As a condition of your use of the premises and facilities and your participation in activites on the premises, you assume all risk of personal injury, death, or property loss resulting from any cause whatsoever including, NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY DUTY OF CARE OWED UNDER THE OCCUPIERS’ LIABILITY ACT ON THE PART OF THE OPERATOR OF THE PREMISES AND FACILITIES and its employees and representatives (hereinafter collectively referred to as “the Operator”).

• You agree that the Operator shall not be liable for any personal injury, death or property loss and release the Operator from all liability and waive all claims with respect thereto.
• Negligence includes failure on the part of the Operator to take reasonable steps to safeguard or protect you from or warn you of the risks, dangers and hazards referred to above.
• Any litigation involving the Operator shall be brought solely within Alberta and shall be within the exclusive jurisdiction of the Alberta Court.
• These conditions and any rights, duties and obligations involving the Operator shall be governed by and interpreted solely in accordance with the laws of Alberta and no other jurisdiction.

The operator's liability for negligence, breach of contract or breach of the occupiers' liability act is excluded by these conditions.

1. Cards are only valid for ages 13+.
2. Cards must be purchased and activated at least 24 hours in advance to access Program benefits.
3. Cards are only valid for the season in which they were purchased.
4. Cards are non-transferable, cannot be resold, and can only be used once per day.
5. Cards will be confiscated in the event of fraud, cardholder impersonation, misconduct or any breach of the Alpine Responsibility Code, or Banff Sunshine’s safety rules and regulations. Depending on the severity of the offence, Cards may be revoked, all Program Benefits will be cancelled, and further criminal prosecution may apply.
6. Cardholders assume all risk of personal injury, loss, or property damage.
7. Child ticket purchases do not count towards cumulative Card visitation.
8. Card sales are final. No refunds or credits for lost, stolen, unused or partially used Cards will be issued, during current or future seasons. Mobile and Direct-to-Lift Card types CANNOT be converted back into unregistered physical Cards.
9. Cards have no cash value and remain the property of Banff Sunshine Village at all times.
10. Terminating this Agreement ends all use of the associated Card and Program Benefits. No refunds apply.
11. The Super Card Direct-To-Lift feature is available at Banff Sunshine Village and Marmot Basin, and will be activated once a waiver and billing agreement is completed and a photo, contact details, and valid credit card information is provided for each Resort.
